Default Can I?

Can I use my girlfriends Vista 64bit backup disk for her new dell laptop for my new desktop build because i really dont want to by the OS??

No you will still need to activate vista with a serial number in 30 days.

Just download the Windows 7 RC
I'm using it now, and its a full featured OS, it will run everything you want.

The disc for her laptop will only work on a dell laptop.
You should heave budgeted in an OS for your build.
