libdvdcss is required to watch video DVD, but it alone, by itself, is just a library. It does not play video DVD.
The fact that several Linux distributions do not include libdvdcss by default (amongst which some do provide easy access to it, e.g., Ubuntu) is more of a political choice than a legal choice.
The idea of committing a crime is more complicated than owning or even using the "wrong" tools.
