You could hand over the drive to a data recovery company and have them do a forensic inspection. If the drive has not defraged there may be a slight chance. Otherwise if something like ccleaner has been run on the drive, they're gone.
 
Anyone tech savvy and looking to remove files quickly and practically permanently probably uses CCleaner with a Gutmann pass (35 wipe passes).

It really all depends on how important the legal matter is as to how much trouble you are willing to go through.
