Make sure the fan is like the picture, it should be infront of the heatsink and then blow through the fins.
If its sucking the air through the fins it could be sucking in from the sides of the heatsink and therefore interrupting the airflow path.
I my self had very great results with lapping a heatsink, so I would try it. Just go out and but some sand paper. Start with 100 grit then go up to 240, then 320, then 400, and then get some of the really fine water proof sandpaper around 500-700 grit and use that. Even if you do it by hand it looks extremely shiny.
And don't worry about the warranty, its not very hard to re seat a heat sink.
