sounds like you are beating around the bush. Whats really going on? In some kind of trouble?
 
According to the law you'd both be in trouble.

the person selling the drive clearly didn't make a good enough job of erasing the data, though a lot of people don't actually make a great job of erasing data cause it's time consuming.

if you recover the data, then you are accessing data that you have no right to access, you're gathering data in an improper way, from individuals who have not consented to have you hold data about them,
worse still if you sell the data you're then breaking the law again.

certainly that's the data protection act in Britain, I'm sure America has simillar legislation.
