it's easy they are not spam because this forum is not sponsored by Windows, linux icons, other OS (sun risc), they don't get sponsored by an car manufacturers, and neither Nvidea not ATI hold any kind of advertising interest here. -That avatar is spam. the use choice ones are not.

like I said it doesn't bother me personally, but it might irritate other mems and new members seeing a mod using his avatar for spam.
tecnically it is against the rules and that was one of the things david was worried about in the custom avatar thread.

people reconise the person by the avatar they look at that more than the name

EG i no Windows logo is LK, Dell Cisco, Mr Mixx Devil, crazyman Pengiun
